Dan Claudiu DĂNISOR -The revision of nothing – about the relations between Constitution, economy and continuous reform

The article presents the necessity to observe the principle of constitutional stability at the expense of repeated revisions. It says that some contradictions are stimulating for the democratic exercise of power; the mentality that destroys this mechanism of “constructive criticism” (inevitable join words) threatens the very construction of the state based on the separation of powers. It is avoided the real division of competences. Analyzing the object of regulation of the Constitution, it is argued that such legal concepts must be neutral; constitutional provisions have as object of regulation the way of production of the other norms. For example, regarding the economy, the Constitution regulates the way the rules of economic behavior are produced and not economic rules themselves. Thus, the application of constitutional concepts should be subject of the revision and not the normative constitutional framework.
